GiftListNow is a universal wishlist registry and holiday gift exchange management platform. We provide tools to help friends, families, and coworkers coordinate Secret Santa drawings, White Elephant games, and personal gift registries. GiftListNow is completely free to use.

3. Account Registration and Security

To access features such as creating wishlists and hosting events, you must create an account. You agree to provide accurate information and to keep your login information secure. You are solely responsible for all activities that occur under your account. We reserve the right to suspend or terminate any account that violates these terms.

4. User Content and Community Guidelines

You retain ownership of the wishlist items, notes, and preferences you submit to GiftListNow. By posting content, you grant us a limited license to store, format, and display that content solely to provide the service to you and the event participants you invite.

You agree not to post content or links that are unlawful, harmful, abusive, harassing, defamatory, or that infringe on any intellectual property rights. We reserve the right to remove any content at our sole discretion.

5. Affiliate Disclosure and External Retailer Links

GiftListNow is 100% free for everyone. When you purchase gifts through links on our site, we may earn an affiliate commission at no extra cost to you.

Our platform contains links to external retail merchants and online stores. When you click an external link and make a purchase, we may receive an affiliate commission at no additional cost to you.

We do not sell, stock, or ship products directly. Product prices, availability, shipping fees, return policies, and merchant terms are controlled solely by each individual retailer and may change at any time. We are not responsible for any purchases made on external websites.

6. Disclaimer of Warranties

GiftListNow is provided strictly on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, 815 Works disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non infringement, and uninterrupted or error free service.

We do not warrant that the website will always be uninterrupted, timely, secure, or free from errors, defects, or data loss.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall 815 Works, its owners, operators, partners, affiliates, agents, or employees be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages. This includes, without limitation, any loss of profits, loss of data, emotional distress, gift exchange misunderstandings, merchant disputes, or unauthorized access resulting from your use of the platform.

In no circumstance shall the total cumulative liability of 815 Works and GiftListNow for any and all claims arising out of or relating to these terms or your use of the service exceed zero dollars ($0.00), or the total amount you have paid to GiftListNow in the preceding twelve months.

8. Indemnification

You agree to defend, indemnify, and hold harmless 815 Works, GiftListNow, and its founders, owners, operators, employees, contractors, and agents from and against any and all claims, demands, liabilities, damages, losses, costs, or expenses (including reasonable attorney fees and legal costs) arising out of or in any way connected with:

• Your access to or use of the GiftListNow platform.
• Your wishlists, links, notes, or any other content you submit.
• Your participation in any event, gift drawing, or gift exchange.
• Your violation of these Terms of Service or any applicable law.
• Your interactions or disputes with any third party, event member, or retail merchant.

9. Dispute Resolution and Class Action Waiver

You agree that any dispute, claim, or controversy arising out of or relating to these terms or your use of GiftListNow will be resolved on an individual basis.

You explicitly waive any right to bring, join, participate in, or maintain any class action, collective action, private attorney general action, or representative proceeding against 815 Works, GiftListNow, or its owners.

10. Account Deletion and Termination

You may discontinue your use of GiftListNow and permanently delete your account and all associated data at any time through your Account Settings under the Danger Zone section, or by contacting our support team.

We reserve the right to suspend or terminate your account and access to the platform at our sole discretion, without prior notice, if we believe you have violated these terms.

11. Governing Law and Modifications

These terms shall be governed by and construed in accordance with the laws of the United States. We reserve the right to modify these terms at any time. When we make updates, we will post the revised terms on this page with an updated revision date.
